Terms of Service

1. General Provisions
These Terms of Service define the rules for providing electronic services via the Polski B1 website (hereinafter: “Service”), available at www.polishb1.pl, and the Polski B1 mobile application for iOS / iPadOS (hereinafter: “App”). The term “Service” collectively refers to both the website and the App.
The service provider is Denys Nehometianov, operating the Service for educational purposes (hereinafter: “Provider”).

Use of the Service constitutes acceptance of these Terms. The Terms are made available free of charge in a format that allows downloading, saving, and printing.
2. Definitions
- User — a natural person using the Service
- Services — features of the website and App, including exercises, beginner course, exam modules, and AI evaluation
- User Content — data entered by the User (written responses, voice recordings) within exercises
- AI Evaluation — automated analysis and feedback generated by artificial intelligence models
3. Type and Scope of Services
The Service is offered free of charge in two forms — the website www.polishb1.pl and the Polski B1 mobile app — and includes:
- Preparation materials for the Polish state B1-level language exam (5 modules: listening, reading, grammar, writing, speaking)
- Beginner course (tutorial) with interactive exercises
- Training exercises with AI evaluation (writing, monologue, image description)
- Access without registration — using the App does not require creating an account
- Newsletter on the website (voluntary subscription)
4. Technical Requirements
Use of the Service requires:
- for the website — a device with internet access and a modern browser (Chrome, Safari, Firefox, Edge) with JavaScript and cookies enabled
- for the App — a device running a version of iOS / iPadOS supported by the App Store
- a stable internet connection (for audio and AI evaluation features)
5. No user account
The Polski B1 app runs without registration and without an account. We do not collect your email, name, or any identifying information. Your progress and answers are stored locally on your device (SwiftData) and optionally synced via your iCloud — the Provider has no access to them.
The App is intended for users aged 13 and above. Users under 13 should use the App under the supervision of a parent or legal guardian. The Provider does not knowingly collect data from children under 13.
On the website, users may voluntarily subscribe to the newsletter (email address is the only data required). You can unsubscribe at any time using the link in every newsletter message.
6. Acceptable Use
The User agrees to use the Service in accordance with the law and good practices. The following is prohibited in particular:
- submitting unlawful, offensive, vulgar content or content infringing third-party rights
- abusing AI features for purposes other than learning Polish (e.g., automated querying, attempts to bypass rate limits)
- automated extraction of Service content (scraping), including exercises, audio files, and source code
- decompiling, reverse engineering, or modifying the exercise rendering engine
- actions threatening the security of the Service or other Users (DDoS attacks, intrusion attempts, exploitation of vulnerabilities)
The App applies a daily AI-request limit to prevent abuse: 20 requests per day on a production device (App Store build). The limit resets every day at midnight in the device’s local time. The counter is stored exclusively in your device’s Keychain — it is not tied to any account.
The Provider may apply additional rate limiting on the backend to ensure Service stability.
7. AI Evaluation (Third-Party Processors)
To grade your written responses and transcribe your spoken responses, the App forwards your answers and short voice recordings to a single AI grading provider. The data is forwarded anonymously — it contains no user identifier or contact details.
The Provider works with the following AI grading partner:
- OpenAI Ireland Ltd. — the only provider that receives your content — all written text (writing tasks, transformations, photo descriptions, dialogues) for substantive grading, and all voice recordings for speech-to-text transcription (Whisper)
Additionally, the App uses text-to-speech (TTS) services that synthesise audio from our own script text and do not receive any user-submitted data:
- Microsoft Ireland Operations Ltd. (Azure Speech — TTS) — voice synthesis from our text
- Amazon Web Services, Inc. (AWS Polly) — voice synthesis (Polish female voices)
OpenAI contractually commits that forwarded data is not used for training AI models and is deleted within at most 30 days. See the Privacy Policy for details. Privacy Policy.
By submitting User Content, the User grants the Provider a non-exclusive, royalty-free license to process such Content solely for the purpose of performing AI Evaluation and displaying the result.
The Provider does not guarantee 100% accuracy of AI evaluation — the result is advisory and approximate. AI evaluation does not replace evaluation by a state examiner and may contain errors or inaccuracies.
The User agrees not to include personal data of third parties or confidential information in User Content.
8. Intellectual Property
All Service content — exercises, texts, audio recordings, graphics, rendering engine, and source code — is the property of the Provider or is used under appropriate licenses.
The User is granted a limited, non-exclusive, non-transferable license to use the Service solely for personal, non-commercial purposes related to learning Polish.
Copying, reproducing, distributing, or commercially exploiting Service content is prohibited without the prior written consent of the Provider.
9. Fees
As of the last update of these Terms, the App and website are entirely free of charge. Use of currently available features does not involve any fees.
If paid services (e.g., a Premium subscription) are introduced, the Provider will give appropriate advance notice. Before any fee is charged for the first time, the User will see the full subscription terms (price, billing period, cancellation mechanism compliant with the Apple Standard EULA) on a dedicated purchase screen and will need to accept them.
10. No Guarantee of Exam Results
The Service is only an auxiliary tool for preparing for the Polish language certificate exam. The Provider does not guarantee passing the state exam or achieving any specific result. Effectiveness of preparation depends on the User’s individual engagement.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. Despite our efforts to ensure quality, exercises, audio recordings, reference answers, and AI-generated feedback may contain errors, typos, or inaccuracies. If you spot a problem, please email polskib1.app@gmail.com — we appreciate the feedback and will fix it as soon as we can. To the maximum extent permitted by law, the Provider disclaims liability for any damages arising from reliance on Service content.
11. Complaints
The User has the right to file a complaint regarding the operation of the Service by email: polskib1.app@gmail.com
The complaint should include a description of the issue and User contact details. Complaints are reviewed within 14 days of receipt.
12. Right of Withdrawal
A consumer has the right to withdraw from a distance contract within 14 days without giving any reason, pursuant to the Polish Consumer Rights Act of 30 May 2014.
Since the Service is free and delivery begins immediately upon use, the right of withdrawal is exercised by ceasing to use the Service (uninstalling the App and/or no longer using the website).
13. Ending use of the Service
You can stop using the App at any time — simply uninstall it from your device. All your data (progress, exercise results) is then automatically removed from the device. If you have iCloud sync enabled, you can also remove the App’s data in your Apple ID’s iCloud settings.
You can stop using the website simply by leaving the page. If you are subscribed to the newsletter, unsubscribe via the link included in every newsletter message.
The Provider reserves the right to restrict access to AI features in case of gross violation of the Terms (e.g., automated API abuse, attempts to bypass limits, content scraping).
14. Liability
The Provider makes every effort to keep the Service functional and continuously available. Given the free nature of the Service, the Provider’s liability is limited to cases of willful misconduct.
The Provider is not liable for:
- Service interruptions resulting from maintenance, third-party provider failures (hosting, AI providers), or force majeure
- the content of feedback automatically generated by AI models
- User decisions made based on use of the Service, including results obtained on the actual state exam
- damages resulting from use of the Service contrary to these Terms
15. Personal Data
Rules for processing User personal data are set out in the Privacy Policy available on the Service.
16. Final Provisions
Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on Electronic Services, and the Consumer Rights Act.
The competent court for dispute resolution is the court with territorial jurisdiction over the Provider’s place of residence, subject to mandatory consumer protection provisions.
The Provider reserves the right to amend the Terms. Users will be notified of significant changes via a notice on the website or within the App at least 7 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
These Terms enter into force on April 21, 2026.
